Terms and Conditions of Use

These Terms and Conditions (“Terms”) govern your use of the WAVE Report platform and website, accessible at www.wavereport.au, operated by We All Value Education Pty Ltd (ABN 69662602324]) (“WAVE Report”, “we”, “our”, or “us”). By accessing or using our services, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use our services.

1. Acceptance of Terms

By accessing or using the WAVE Report website and associated services, you confirm that you are over 18 years of age and have the legal capacity to enter into these Terms. If you are accessing the platform on behalf of a school, organisation, or other entity, you represent and warrant that you are authorised to bind that entity to these Terms.

2. Services

WAVE Report is a digital platform designed to support student wellbeing and behaviour tracking by enabling educators to provide periodic non-academic ratings and share them with parents or guardians.

We reserve the right to modify or discontinue any part of the service at any time without notice.

3. User Accounts

To access certain features of our platform, schools and educators must register for an account. You agree to:

  • Provide accurate and current information during registration
  • Maintain the security of your login credentials
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that breach these Terms.

4. Privacy and Data Use

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy found on our website.

By using WAVE Report, you consent to the collection, use, and disclosure of data as described in our Privacy Policy, including information relating to student wellbeing and behavioural feedback.

5. Permitted Use

You agree to use the platform solely for lawful and authorised educational purposes. You must not:

  • Use the service in any way that breaches applicable laws or regulations
  • Transmit viruses, malware or other harmful code
  • Attempt to gain unauthorised access to the platform or interfere with its integrity or performance
  • Copy, modify, distribute, or resell any part of the platform without our written consent
6. Intellectual Property

All content, features, and functionality on WAVE Report — including text, graphics, software, and design — are the property of We All Value Education Pty Ltd or its licensors and are protected by Australian and international copyright laws.

You are granted a limited, non-exclusive, non-transferable licence to use the service for educational purposes only.

7. Limitation of Liability

To the maximum extent permitted by law:

  • WAVE Report and its affiliates are not liable for any indirect, incidental, special, or consequential loss arising from your use of the platform.
  • We make no guarantees that the service will be uninterrupted or error-free.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law (ACL) that cannot be excluded.

8. Third Party Links and Services

Our platform may contain links to third party websites or services not owned or controlled by us. We are not responsible for the content, policies, or practices of any third party services.

9. Fees and Pricing

WAVE Report may charge subscription or usage based fees. All pricing is listed in Australian Dollars (AUD) and includes GST unless stated otherwise.

We reserve the right to update our pricing and fee structure at any time. We will provide reasonable notice of any price changes by publishing them on our website or notifying registered users directly. Continued use of the service after a price change constitutes acceptance of the new fees. You are responsible for all applicable charges and taxes associated with your use of the service.

Subscriptions are billed on an annual basis unless otherwise agreed in writing. You may cancel your subscription at any time by providing written notice at least 30 days prior to your renewal date. If no such notice is received, your subscription will automatically renew for another 12-month term.

No partial refunds will be issued for unused periods if you cancel after the renewal date.

10. Termination

We may suspend or terminate your access to the platform immediately if you breach these Terms, without notice or liability.

Upon termination, your right to use the platform will cease, but sections intended to survive such termination (e.g. intellectual property, liability disclaimers) will continue to apply.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from or related to these Terms or our services must be resolved in the courts of Queensland.

12. Changes to Terms

We may update these Terms at any time by publishing the revised version on our website. We encourage you to review these Terms periodically. Continued use of the service following any changes constitutes acceptance of the revised Terms.
